1. Contractual partner

The contractual partner is SOLIT Management GmbH, Otto-von-Guericke Ring 10, 65205 Wiesbaden  (hereinafter "SOLIT"). 

2. Conclusion of contract for orders

2.the presentation of products in the online store does not represent a legally binding contract offer on the part of SOLIT, but is merely a non-binding invitation to the customer to order products. By clicking   on the  button  [order with obligation to pay]   you  submit a binding purchase offer . SOLIT can accept this offer by sending a separate order confirmation by e-mail within five days. The confirmation of receipt of the order is sent by automated e-mail immediately after sending the order and does not constitute acceptance of the contract.

2.2 The order is placed in the following steps:

  • Selection of the desired products
  • Adding products to the shopping cart by clicking the "Order" button
  • Checking the information in the shopping cart; the products can be removed from the shopping cart or changed again by clicking on [Change] and [Delete]. Input errors can also be corrected by the customer navigating backwards in the browser or canceling the ordering process and starting again from the beginning.
  • Pressing the button "Order with payment"
  • SOLIT confirms receipt of the order immediately by sending an automatically generated e-mail ("confirmation of receipt").

The Contractual Partner receives an e-mail about the acceptance of the order ("Order Confirmation"), insofar as the order has been accepted by SOLIT . 

3. Conclusion of contract for purchases

Customers have the opportunity to offerprecious metals for purchase to SOLIT  via the online store. The purchase takes place in the steps explained below:

3.1 The customer submits a request for purchase via the online store, stating the type, volume and quality of the goods to be sold (hereinafter "purchase request"). The current price offered by SOLIT for the purchase(purchase price) can be found on the button [Sell for "purchase price" €/piece] on the product page. This price corresponds in principle, unless otherwise stated, to the purchase price of goods as good as new, i.e.  there are at most defects that are due to the respective production process.

The customer is then redirected to the registration form. Here the required contact details and the number of pieces offered by the customer are to be indicated. In order to submit the offer to SOLIT , the customer must click the [Send] button displayed. The customer will then receive a confirmation of receipt of his offer by e-mail; this does not yet constitute acceptance of the contract by SOLIT .

3.2 After receiving the confirmation of receipt from SOLIT , the customer must hand over the goods offered by him to SOLIT within 3 days. This can be done:

  • by direct handover to SOLIT,
  • by shipment to SOLIT 
  • or
  • by collection from SOLIT .

Until the time of handover to SOLIT or a person authorized by SOLIT for this purpose, the customer bears the risk of accidental loss and accidental deterioration of the goods.

If the customer commissions SOLIT to collect the goods, the goods must be made available for collection from the next working day after receipt of the confirmation of receipt.

3.3 The goods offered for sale will be subjected to an authenticity check (authenticity of the precious metal offered) and a condition check (qualitative condition of the precious metal offered) within 7 days of receipt by SOLIT .

3.4 After the examination according to paragraph 3.3, SOLIT sends the customer either the acceptance of the purchase request at the agreed purchase price, i.e. the contract confirmation or the rejection of the purchase request by e-mail. The goods will be returned to the customer within 7. The customer can also pick up the goods instead, if he declares this to SOLIT within 3 days by e-mail.

4. Storage of the contract text

SOLIT stores the customer's order and the order data entered. The customer receives an order confirmation by e-mail and subsequently an order confirmation with all order data including the General Terms and Conditions. The General Terms and Conditions can also be viewed at any time at and printed out if necessary. The order data can also be viewed at any time after receipt of the login data in the customer area. 

5. Right of withdrawal for consumers

According to § 312 g para. 2 no. 8 of the German Civil Code (BGB), the right of revocation does not apply to distance contracts for the delivery of goods whose price is subject to fluctuations on the financial market over which the entrepreneur has no influence and which may occur within the revocation period, such as the delivery of precious metals.

Your order of precious metal bars and coins is therefore not revocable. Only for non-precious metal products there is a right of revocation.

Right of withdrawal

You have the right to revoke this contract within fourteen days without giving any reason. The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has or has taken possession of the goods. In order to exercise your right of revocation, you must send us

by means of a clear declaration (eg a letter sent by mail, fax or e-mail) about your decision to revoke this contract. You can use the attached sample revocation form, which is not mandatory.

In order to comply with the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the expiry of the revocation period. 

Consequences of the revocation 

If you revoke this contract, we shall reimburse you all payments we have received from you, including delivery costs (with the exception of additional costs resulting from the fact that you have chosen a type of delivery other than the most favorable standard delivery offered by us), without undue delay and no later than within fourteen days from the day on which we received the notification of your revocation of this contract. For this repayment, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no case will you be charged any fees because of this repayment. We may refuse repayment until we have received the goods back or until you have provided proof that you have returned the goods, whichever is the earlier.

You must return or hand over the goods to us without undue delay and in any case no later than within fourteen days from the day on which you notify us of the revocation of this contract. The deadline is met if you send the goods before the expiry of the period of fourteen days. You shall bear the direct costs of returning the goods. You will only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking the condition, properties and functioning of the goods. 

Pursuant to Section 312 g (2) No. 8 of the German Civil Code (BGB), the right of revocation does not apply to distance contracts for the delivery of goods or the provision of services, including financial services, the price of which depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur within the revocation period, in particular services relating to shares, to units in open-ended investment funds within the meaning of Section 1 (4) of the German Investment Code (Kapitalanlagegesetzbuch) and to other tradable securities, foreign exchange, derivatives or money market instruments.

7. Payment methods

The payment of the customer takes place alternatively by prepayment by advance bank transfer, by giropay or - with special agreement - cash payment with collection. In the case of payment in advance by bank transfer, SOLIT will provide the bank details in the order confirmation e-mail. The invoice amount is to be transferred to the specified account within 3 working days. In case of payment by giropay you will be redirected to the payment pages directly from the order process and make the transfer.
